Expungement in North Carolina

On June 25, 2020, Governor Roy Cooper signed the Second Chance Act (the “Act”) into law. The Act broadens the availability of expungement of convictions in North Carolina.

Underage Convictions

Part I of the Act provides that certain convictions before December 1, 2019, for crimes committed between the ages of 16-18 are eligible for expungement. Certain convictions such as DWI’s or a conviction which requires registration as a sex offender are not eligible. GPS Law group will be happy to determine whether your conviction is eligible, and if it is eligible, we would be glad to help you with the process of petitioning to have your charges expunged.

Charges Not Resulting in Conviction

Part III of the Act provides that any charge not resulting in conviction before December 1, 1999, is eligible for expungement. If you were charged with a crime and not convicted before December 1, 1999, GPS Law group will be happy to determine whether your conviction is eligible, and if it is eligible, we would be glad to help you with the process of petitioning to have your charges expunged.

Nonviolent Misdemeanors and Felonies

Part IV provides that a person convicted of a single nonviolent misdemeanor may petition for expungement after five years. A person convicted of multiple nonviolent misdemeanors may petition for expungement after seven years. A person convicted of a nonviolent felony may petition for expungement after ten years. GPS Law group will be happy to determine whether your conviction is eligible, and if it is eligible, we would be glad to help you with the process of petitioning to have your charges expunged.
